Requesting a name change with legal assistance

Changing your first name
To change your first name, you must file a petition with the court. You will need a name change lawyer. The judge will consider whether you have a valid reason for changing your first name. This could be because of:
- The meaning of the first name in another language
- Bullying because of the first name
- Psychological suffering because of the first name
- Gender reassignment
- Religion
- Adoption of a child
If you want a different first name for your minor child, the petition must also be filed by the legal representative(s). The court will invite minors over the age of 12 to an interview to express their opinion on the change of first name.
Changing your surname
Service Justis, the screening authority, handles requests for surname changes on behalf of the Secretary of State for Justice and Security. You can apply to Dienst Justis for a name change on your own. However, it may be advisable to hire a lawyer who specializes in name changes to prepare the application carefully.
A surname can only be changed in exceptional cases, for example:
- Dissolution of marriage
- A surname that is difficult to pronounce
- An inappropriate or ridiculous surname
- A common surname
- A misspelled surname
- Psychological distress
- Adoption
If you wish to change the surname of a minor child, you must submit the request as their legal representative(s). In the case of an adoption, the name change may be requested at the same time as the adoption petition.
Combined surnames
Since January 1, 2024, the law "Introduction of combined surnames" has been in force. Since then, parents have been able to choose to give their child a surname composed of both of their surnames. This change provides more freedom of choice and emphasizes the bond between parents and child.
