Adoption

Are you considering adopting a child? Or do you already have a foster child and want to formalize legal parenthood?

The adoption process can be complex and emotionally taxing. Whether you are dealing with domestic adoption, international adoption or stepparent adoption, legal representation is essential to make the process go smoothly. At our law firm, you will find the expertise and guidance you need.

The different forms of adoption

Domestic adoption

This is the adoption of a child born in the Netherlands. The process goes through the Child Protection Council and the court. Domestic adoption can involve babies given up for adoption as well as older children.

Stepparent adoption

If you adopt a child from your partner, such as in a blended family, we refer to it as stepparent adoption. This process formalizes the stepparent's role as a legal parent, which can be important for rights and duties to the child.

Foster parent adoption

Foster parents can adopt the foster child in some cases. This often happens when the child has been in the foster home for a long time and has developed a strong emotional relationship with the foster parents.

The adoption process

  1. Application and investigation: The first step is to apply for adoption. The Child Protection Council conducts a comprehensive investigation to assess whether adoption is in the best interest of the child, and the parents are screened for suitability as adoptive parents.
  2. Judicial review: The court plays a crucial role in the adoption process. After the screening is complete, the judge decides whether to approve the adoption.
  3. Finalization and legal ramifications: Once the judge approves the adoption, you officially become the child's legal parent. This means that all legal ties to the biological parents are severed and the adoptive parents receive the rights and obligations that come with parental authority.

Global Parents’ Day

Global Parents’ Day

Today, on International Parents' Day, my blog pays tribute to parents worldwide for the great efforts they make in the interests of their children. For parents who have reached constructive agreements with each other in a divorce situation, I take an extra deep bow. For parents in or after divorce who have not yet found a sustainable solution, I share three tips with a worked example based on the model of connecting communication to take advantage of.

Compound families: the maintenance obligation of stepparents

Compound families: the maintenance obligation of stepparents

According to Dutch law, as a stepparent you are obliged to contribute to the costs of your stepchild(ren). When are you legally a stepparent and when are you maintenance obligated for your stepchild(ren)? And is the stepparent's maintenance obligation the same as that of the legal/biological parent(s)? These questions are answered in this blog.
