Divorce

Divorce

Divorce is one of the most traumatic events in a person's life.

You will be faced with a myriad of questions: How do I make the best arrangements for the children? Can I continue to run my own business after the divorce? What will happen to my home? And if you live abroad or are married under a prenuptial agreement, the complexity can be even greater.

At Delissen Martens, we understand how emotional and complicated this phase can be. Our specialized family law attorneys, including an experienced divorce attorney, are here to guide you, both legally and emotionally, through every step of the process.

When might you need a family law attorney?

There are several situations in which a family law attorney can assist you. If children are involved, an attorney can help you set up a parenting plan and child support agreements. If you have a business, you may need specialized advice to ensure the continuity of your business. We also provide appropriate legal advice in divorce cases that involve international issues, such as residency abroad.

Three routes for your divorce

Every divorce is unique and at Delissen Martens we offer you three routes tailored to your situation:

1. Mediation: This is a calm and constructive way to come to an agreement. Our mediator guides you and your ex-partner through the discussions, focusing on finding solutions together. This avoids lengthy court proceedings and ensures a sustainable basis for the future, especially if there are children involved.

2. Collaborative Divorce: Do you feel uncomfortable without your own lawyer at the table? In a collaborative divorce, you have your own divorce attorney, while the other party is also represented by an attorney. Together with a coach, discussions are held in an open atmosphere with the goal of finding solutions without going to court.

3. Unilateral divorce proceedings through the court: In some cases, counseling is not an option and legal action must be taken. We ensure that you are carefully prepared and that your interests are best represented, whether it is property division, child custody or other complex issues.

Vragen & antwoorden

Mediation of procedure?
