Chavez-Vilchez

Stay with a Dutch child ("Chavez-Vilchez").

The Chavez-Vilchez ruling offers foreign parents the opportunity to stay in the Netherlands with their minor Dutch child. This ruling has resulted in a special type of residence permit for Dutch children, provided that you are actually responsible for the daily care and upbringing of the child.

In such cases, the Immigration and Naturalization Service (IND) carefully examines whether there is a genuine family and care relationship. A positive assessment can lead to the granting of a Chavez Vilchez residence permit, which legally secures your right to stay in the Netherlands.
