The legal framework for industrial or service accidents
Article 4 of the Regulation on Accident Reports and Reporting of Medical Matters describes when an accident is classified as a service accident. For example, this would be the case during a deployment or under conditions simulating war.
Article 5 of the same regulation specifies when an accident is considered a work accident, such as during work at regular defence locations or during service sports. This classification determines your entitlement to benefits and regulations in the event of personal injury due to a service or industrial accident.
The impact of an incorrect report
Accident reports are generally considered to be the guiding factor in decisions about the legal position of military personnel. An incomplete or incorrectly drawn-up report may result in your being ineligible for certain benefits or compensation. For example, correct recognition of an accident in the line of duty provides access to specific provisions, including compensation for personal injury and long-term benefits.
However, if the accident is classified as occupational, these arrangements do not apply. In fact, if the accident is not recognised, it can lead to a reduction in pay after the first year of illness.
