Billing disputes

In construction projects, disputes over invoices frequently arise. Often they involve ambiguities surrounding the contract sum, contingencies or costs when working on a directional basis. This can lead to surprises and disagreements, especially when expectations do not match reality.

Common invoice disputes

1. Fixed contract sum

With a fixed contract sum, the parties agree on a total amount in advance. Problems arise when additional costs for extra work are charged without a clear agreement. This can lead to conflicts about who should bear these costs.

2. Suppositions

An estimate is an amount reserved in advance for certain materials or work, the exact cost of which will not be determined until later. Disputes often arise when the final costs differ greatly from the estimate, which can lead to unpleasant surprises for the client.

3. Management basis

Work on a time-and-expense basis means that billing is based on hours worked and materials used. Without clear agreements on timekeeping and use of materials, disputes about the amount of the invoice can quickly arise.
