What is neighbour law?

Neighbour law comprises all the laws and regulations that govern the rights and obligations between neighbours. It defines how neighbours should behave towards each other and each other's property. Despite the clear provisions in neighbour law, disputes can still arise. These disputes range from issues about property boundaries, property divisions, overbuilding, and drainage, to problems surrounding planting and windows within two metres of the property boundary.

What is unlawful nuisance?

Unlawful nuisance occurs when nuisances such as noise, odour, or shadowing disturb the normal living enjoyment of neighbours.

When can I enter my neighbour's plot?

The ladder right allows you to temporarily enter your neighbour's property for necessary maintenance under certain conditions.

Can I demand that my neighbour prunes his trees?

Yes, if the branches hang over your property boundary, you can demand that the neighbour prunes them.

Can I put my fence on the property line without permission?

No, the installation of a property fence on the property boundary requires the consent of both neighbours.

Can I install a window overlooking my neighbour's garden?

According to neighbour law, you may not place a window or opening that directly overlooks the neighbour's plot if it is within 2 metres of the property boundary, unless the neighbour gives permission.

Can I obtain property by prescription without the owner's knowledge?

Yes, prescription can occur without the original owner's knowledge, as long as the conditions are met.

What is the difference between acquisitive and liberatory prescription?

Acquisitive prescription refers to acquisition of property after 10 years in good faith, while liberatory prescription can occur after 20 years without good faith.
