Types of commercial premises (290 commercial premises or 230a commercial premises)

According to Dutch tenancy law, there are two types of commercial premises: 290 and 230a. This distinction has significant implications for the level of rent protection and the rights and responsibilities of both parties.

290 commercial premises are properties in which a retail business, catering establishment or craft business is located, with direct delivery of goods or services to the public. Examples include restaurants, shops and supermarkets. This category is subject to strict rules regarding the duration and termination of the lease agreement, among other things.

The 230a category includes all other types of commercial premises, such as offices, warehouses and factories. In this category, the parties have more freedom to determine the terms of the contract. While the tenant does not enjoy rent protection, they do enjoy protection against eviction.
