Moving abroad

I would like to take my children with me, but my ex-partner prevents me from doing so

In the Netherlands it applies that if parents have joint parental responsibility for important matters relating to their children, they will take decisions together. This also applies for a removal to another country. If your ex-partner does not give permission, you may request the court to grant alternative permission to move with the children to another country. In order to be granted permission as requested it is important to prove that there is a need to move abroad. Not every relocation to another country will be honoured by the court. And you also must have a well-considered plan, in particular as far as being able to continue to maintain contact with the parent remaining behind. We can provide you with more detailed advice on this matter.

If you are confronted with a relocation request of your ex-partner, we can also advise you how to deal with such a request and we can assist you in legal proceedings initiated by your ex-partner. Such a removal may also imply financial consequences. Delissen Martens can also provide you with advice on changes to the maintenance, if any, in such a situation.
