As an employer, you may have the desire or need to redesign your organization because it is better for more efficient operations. There may also be various setbacks, such as a decrease in the number of customers, bills not being paid,the establishment of a competitor nearby or even an impending bankruptcy. These situations may necessitate reorganizing your business.

When is reorganization appropriate

Except in the case of a poor financial situation or a decrease in the amount of work, reorganization may also be the appropriate route in other cases. For example, an organizational change may be necessary or technological changes (for example, automation of certain processes) or a business relocation, as a result of which the workforce must be reduced.

Implementing reorganization

Implementing a reorganization is subject to various rules. This is not surprising: the consequences for an employee who loses his job as a result of a reorganization are great. It is important that the employer makes clear why he has made certain choices and also that he makes it as objective as possible which employees will become redundant as a result.

A (collective) dismissal request can only be made to the UWV. Only after permission from the UWV has been obtained, and the employer has also made it clear that redeployment elsewhere in the company is not possible, can the employer proceed to terminate employment contracts. To avoid a UWV procedure, agreements can also be made with the employees by mutual consent to terminate the employment contract.

Prior to the UWV dismissal request, in certain situations the works council and/or trade unions will also need to be involved.
